I hope Trump does realize in order to appeal this particular verdict he needs to put up the 83+ million dollar verdict awarded to the victim, it's like a surety payment to the true victim of Donald's stormy horny ways...
gonna be a fair bit more than 83M actually. when they have to put up those bonds, they put up enough money in surety to cover the damages awarded to the victim or the receiver in case the appeal is rejected or ruled against them, and then they tack on another percent to that to cover for inflation and legal costs and shit.
not only that but it's not like a bail bond where he only has to put down about 10% upfront. for supersedeas bonds he would have to put up ALL of the money upfront.
he put down 5.5 million on his supersedeas bond to cover the 5.0 million verdict in the first rape/defamation trial just so that he can appeal the ruling. i'm not sure how exactly they calculate the numbers for the surety, but just using that as a baseline, i would assume he'd have to pay in somewhere in the ballpark of 91-92 million dollars in order to appeal this 83.3m ruling.
i really don't think he's going to appeal this. first of all they don't really have much to appeal on. his "lawyer" didn't even object to any of the evidence as it got introduced to trial. and even though his attorneys done him no favors and basically hung him out to dry, he can't even appeal on the grounds of incompetent representation because you can only do that in criminal trials.
they can't even try to accuse a judge of being unruly, as trump acted out so many times in front of the jury trying to sabotage this shit, even after being warned over and over again, and the judge still kept his composure and gave him a long leash, even though any other defendants would have been removed from the courtroom if they tried that shit. they wouldn't get 10+ warnings to stop doing the same malicious activity.
i don't know what grounds they have to appeal on. you won't be hearing alina habba ever telling you this, but they do not get to retry their case. they do not get to enter any new evidence. they do not get to bring in any new witnesses. being unhappy with the amount of damages issued is not grounds for an appeal. in order to win an appeal, they have to find legal holes in their trial and demonstrate to the appeals court that they were wronged, or prove that some kind of statute of the law was wrong or misrepresented. they can't speculate that they might have been wronged in trial. in order to appeal, the onus is now on them to actually have to find evidence of such malpractice, and then prove to the appeals court that they were wronged, and whatever way they were wronged had directly impacted the juries decision against them. only then will the appelate courts decide to take action to try to rectify the lower courts decision.
and even if they did manage to have a solid argument for appeal, most of the time it's not going to result in the case getting thrown out unless some real fucking shady and highly illegal shit went down during the trial. in all likelihood the amount of the damages assessed would just get reduced.
appeals are much much harder to win on than civil trials in district courts. if you didnt have much of a case to make in the first place, youre fair dinkum fucked on appeals unless something happened during your trial that went completely off the rails.
will it be worth putting down 90+ million just to roll the dice on an appeal? they better damn well hire some real attorneys and have something concrete and convincing, otherwise e jean carroll is going to get a quick and easy payday.
honestly, i don't think they will actually try to appeal this. the 5.5 million to trump is nothing, he can afford to lose that, and he pretty much has to fight it if he doesnt want to keep getting sued for defamation due to e jean carroll's new infinite money glitch she discovered because he can't keep his mouth shut. he has to fight this just to save himself from bigger lawsuits.
but the 83.3 million? thats going to sting his pocketbooks alot. i don't think he's willing to put that on the line, when he could just try to tie the courts up and hide his money and assets just to try to avoid paying her. but the other thing is, while stupidly trying to gloat and impress, he literally just said while under oath that he has more than $400 million of cash on hand, so if he tries to declare bankruptcy and squirrel his money away, they can hit him up for perjury. he just can't keep his mouth shut.
