ATF Brace Rule

What's ya'll take on the new ATF brace ban?

Power grab and the ATF knows it. How many times did they try to put something out and pull it back? They know they're in the wrong, but the new director doesn't seem to care. After the EPA was told they didn't have the power to make law and then the bump stock ban being over-turned I can't see this ridiculous brace rule staying around for more than a couple of years (hopefully less with the pending litigation in Texas that was waiting on the final rule before they filed).

I think most everyone involved with firearms is fed up with the ATF flip-flopping, etc.

Will be interesting to see what this does to the the NFA too.
 
They were fine then they weren't. Makes one think perhaps the statute isn't clear and that until Congress passes legislation then the ATF should err on the side of civil liberty.

After Bruen though, where is there any text, history, or tradition to regulate barrel length on rifles?

I mean . . . doesn't the ATF say that "Illegal SBRs were sold for years as AR pistols" but yet we haven't seen any noticeable rise in crime because of it? Yet they're trying to say this is for "safety"?

The thing is now that "safety" isn't an argument. They have to make the case that the NFA and GCA give them statutory authority. They also now have to show that similar laws were common at the time of the founding, since clearly nothing in the text of the 2nd excludes rifles with barrels under 16".

Same for most of mine….but the digital version sent still has the image of a $200 stamp at top right hand corner with a box marked tax paid.

I built all of my sbr’s so e-filing was easy. My suppressors were purchased from a store so no e-filing on those.
 
Supposedly there are 10 to 40 million pistol braces out there in the country. Is there some kind of crime wave caused by these that the ATF can point to here.....? I didn't think so. The vast vast majority of gun crimes are done with handguns.

Still not on the Federal Register. Youtube is filled with videos about what can happen should this magical "grace" period elapse. My weapon can only be identified as an "other" firearm and nothing else. Not interested in a Tax Stamp at all. I am still waiting to see how my liberal state reacts to the rule change. My personal suggestion is that other folks keep their weapons as a pistol, rifle, or "Other" firearm. Some folks are already on the NFA books or don't mind registering for a SBR, SBS, or AOW. More power to them. Folks should do what they feel is in their best interest.

I'm sure there will be a ton of law suits. But this isn't a ban or a new law. They are just adjusting the rules already on the books. Which every other federal agency does quite regularly. So it's hurry up and wait.

Other is not the place we want to keep AR pistol classification. They need to be classified as pistols simply do to the common use provisions of the NFA. Or the NFA needs to be repealed entirely.

I have to have an "Other" firearm, because my state banned AR pistols and rifles. But in their infinite wisdom (at least for now) they neglected to ban all weapon types they deem as AW's. I do like how you finished your statement though. Repeal would be ideal.
