That isn't true, there are witnesses speaking up. One guy named Vasquez was on news today. He is the one that recorded some of it. I can post 12 stories from this year where that exact situation turned violent including some murders. The guy should have never been on the streets.
If you have a source for someone other than Penny, his legal team and relatives, and the 'anonymous witness' who evaporated early on, saying that Neely made specific threats to anyone or touched them, please post it.

Edit: IIRC no one says he touched anyone.
 
I think the only one saying that is Penny. The 'anonymous witness' who confirmed it seemed to evaporate. IIRC Neely's behaviour was threatening, but he came no closer than 6" from anyone and made no specific threats.

Contrary to popular belief getting beaten up does not stop mad/bad people from doing mad/bad behaviour.

My only comment on the whole situation is that if someone’s going to apply a chokehold learn how to do it properly. You can’t just keep applying pressure because the subject eventually passes out and dies. You have to back off periodically to let their brain get some oxygen.

That’s the overall law. Judges after the case is presented essentially highlight the critical areas of the law in each case and where priority should be given to the jury. They also expand on areas that are critical to the case, like the judge will give their definition of “reasonably believes” in a more plain English.

In self defense cases, the areas of focus can really affect things.

Unless NY does it differently than other states I’m familiar with and it’s all boilerplate depending on the charges and formal defense?
I’ve been kinda interested in the topic of jury instructions. It seems the state does create a set of instructions under three categories but they are non binding.
I do a lot of work on mock trials and have noticed that the jury charge is pretty standard.
Anyway, some info I found.
 
Most of these crazy dudes on trains just need a good ass kicking. They are like bullies on the playground, it emboldens them when people put their heads down and say nothing.
We need to set Russell Crowe loose in the subway.
 
I live it and see it every week. A guy steps onto the train and starts his shit, and everyone puts their heads down and hope he leaves after he threatens people. Last week a barefoot homeless guy dances with a cup and expects handouts. If you don't put change in the cup he was spitting on people. I have seen it go both ways, sometimes they are just talk, sometimes they aren't. This guy Jordan threatened to kill people and stated he was willing to go to jail. I believed him. Truth is they are usually so filthy and smell so bad you don't want to get near them. The ex-Marine defended the train. He should be exonerated. If he did not intercede a normal citizen could have been attacked or killed like so many others have this year. I feel bad this tragedy happened, but you can't let mentally ill violent people run around terrorizing people like they do now. Many have weapons like knives and axes. Unfortunately a lot of these people have medical conditions brought on by their addictions and illnesses that cause them to die during altercations faster than a healthy perp. The city is trying to curb the issue but they need to make it a law that homeless are not allowed in Stations and on train cars where they are sleeping, vomiting, pooping and in some cases doing drugs requiring needles. There needs to be places to bring these folks, and if they don't agree, jail them. It has gotten to be too dangerous.

Just in the last 3 months in NYC trains/stations:
16 People have been pushed onto tracks. 25 all of last year were pushed.
2 Conductors have been attacked with weapons.
388 Total incidents were reported from Jan 1 to March 2rd, up 13% from last year.
Homeless in the Subways and stations was way up over the same time last year.


honchol is disgusting as is alvin bragg, who continues to let these criminals walk. He is as bad as larry krasner of Philly, Kim fox of Chicago, and George gascon of LA, who refuses to add gun enhancements or gang enhancements or three strikes because it affects people of color more often-same as krasner who has said several times, that he refuses to prosecute black and brown felons with firearms-yet he blames the nra and white gun culture for flooding his streets with guns. Fucking clowns.

And Penny is getting railroaded here. Hopefully, there are sensible people on the jury-maybe some sick of all the violent crime on subways and in the city. I get it that it is a city of 9 million, but the DA refuses to prosecute and the court system refuses to hold people like neely who tried to kidnap a young girl and shoved an old lady onto the tracks if I recall correctly.

Because of the threat these nutbag criminals pose and the threat of facing criminal charges, no one else will ever step up to deal with these scum.
 
Because that would be racist of course. The health and wellbeing of citizens is a secondary concern to the wants and needs to illegal immigrants.

It is consistently baffling to me that the system is powerless to stop criminals but the moment a good person stands up for themselves the system seems to have all the resources in the world to punish them... Until you look at it from the standpoint that the people in charge want us to suffer. Thats the only viewpoint that makes it make sense.

Witnesses describe Jordan Neely taking on a fighting stance while shouting death threats:

- "someone is going to die today"
- he said he "would kill anyone"
- he said he wanted to "take a bullet"
- he was "ready to go to Rikers"
- "ready to do life"

A witness specifically recalled him saying: "I want to hurt people. I want to go to Rikers. I want to go to prison."

The witnesses all testified to being terrified.

This has always bothered me as well. If you or I got arrested for even something stupid, it could ruin us from getting jobs, the social embarrassment, publicity, etc. but some shitbag gets arrested for the 30th time, and the system just throws up their hands and says “oh well, what do you want us to do-he won’t stop breaking the law.” And I am screaming “lock him up damn it!!!” I have argued this in court to the prosecutors and judge, but you can’t do it in front of a jury because it supposedly prejudices them.


I had a case that I was thinking about the other day that we caught a pimp standing over his gf/hooker with a bike held above his head. She was screaming for help while 50 people stood and watched. Hell, they even blocked us from entering the alley in the cruiser and we had drive around them. Arrested him and fought him. She told us he hit her with the bike. She had marks and even black marks from the bike tire on her legs. She was also six months pregnant. Went to trial, I testified to what we saw and what we were told by her and a witness. This was his sixth arrest for domestic battery. Had two convictions. Three is a felony. This would have made him a habitual three strike felon because he was also a dealer and had armed robbery convictions. He was looking at serious time. The jury found him not guilty. Fucking insanity. One of the jurors was a prosecutors wife. She should have been disqualified from being a juror, but they allowed it. So I was super pissed off about it. Her family owned a big car dealership and since she was the only juror I knew, I blamed her. She had her husband speak to me because I was bad mouthing her and her dealership and told officers not to buy cars off of them. Her husband said that the jury didn’t want to believe her for two reasons. One, she had a previous conviction for perjury. They were allowed to bring that up but we couldn’t say shit about all his arrests and convictions, but they were allowed to use that to call her testimony into question. Didn’t matter to them that I saw him holding the bike above his head, saw the marks on her legs. At the very least, they could have convicted him on domestic assault for placing her in fear of receiving harm. The second reason was because she was a pregnant crackwhore.

If that had been you or I, we would have been railroaded and lost the right to firearms and that would be on our record. Of course, if you do that, you deserve the punishment, but the jury didn’t like her. He was an asshole and I arrested him dozens of times. His name was Elvis(he was also black, which made it funny) and his street name was Elmo or elbow. I even did an op order once I became a lieutenant that was called “tickle me Elmo” because it was designed to target a crackhouse and whorehouse that he managed. We took him down as well as about twenty other people. We caught someone that bought crack off of him and we got him to be an informant and bought off of him a few more times and we used that to get a search warrant. When we kicked in the door, someone even ran up the steps and out onto the roof and tried to jump to the next roof and fell 30 feet onto a steel fence and died. It was absolutely insane. It became a circus with people accusing police of pushing him off the roof-but shitbags gonna shitbag. He had a backpack full of crack and guns and was a victims felon. So no loss, but imagine how crazy that is-raiding a house for drugs, hookers, and guns and a guy runs and falls off a roof. Luckily, there were dozens of decent neighbors that saw the whole thing so that put those rumors to rest, but the shitbags still blamed us for daring to raid a crackhouse where they were selling whores, drugs, and guns.

While I wouldn’t blame law enforcement because they arrested him dozens of times and did their job-It was the rest of the legal system and politics that prevented that asshole from getting justice leading Penny to take out the trash. Still, anqueefa and blm shut down the subway and streets over a complete piece of shit that tried to kidnap a young girl and shoved an old lady onto the train tracks. I'm not advocating for anyone get killed. But if I choose to take a stand and defend someone, it's going to be worth it. Are you able to express any sympathy for the woman that was recently pushed onto the tracks and had her feet amputated?
