The issue is she is underage.
The 18 year old having sex with a 17 year old is not the issue. The issue is there is pornography involving a 17 year old.
He fucked up bigly by recording her while she was 17. He could have waited a year and did a pron remake of Dances with Wolves with her and it would have been all cool.

I am more pissed at him stealing a lady with a brain tumor last 75 bucks than the video but the crazy part is legally he is in more trouble for the video.

That is why discretion is important in these types of cases 16 and 18 is pushing it but it’s still in the bounds of just two stupid kids before we stick people on the registry for life. I think we can use a little common sense.

On general principle, and not only when it comes to sexual matters, I believe that (a) what people are allowed to do and (b) what people are allowed to record, distribute and potentially profit from; should be considered and judged by completely separate sets of rules.

you're right about that. two people having sex is not pornography. until you park a camera in front of them. a minor having sex is not child pornography. until you park a camera in front of them.

any visual depiction of a minor engaging in sexual activity is defined under law as child pornography. that minor is not legally old enough to give their consent to be captured engaging in any type of sexual activity. period. the law is the law.

and who cares if the guy is 18? or 81? he's still an adult, and by then he should probably know better than to record videos of minors having sex.

i mean i really didn't think there would be any people on this forum who would defend child pornography in any which way, but here we are. i mean sure, 17 year olds are going to have sex. but nobody should ever be capturing video of them engaging in any form of sexual activity. until the person turns 18 years old, they are not legally old enough to consent to that type of activity. even if the person in the video is 17 years and 364 days old, they are still defined under law as an underage minor, and it is still very much defined under law as child pornography, and in no state is that legal. being almost 18 years old does not equate to being 18 years or older.

the law is very clear on this. child pornography is defined as any visual depiction of a minor engaging in sexual activity. a minor is defined as anyone under the age of 18. if you would like to dispute that, then how about you go record a video of a 17 year old girl having sex and upload it to the "a little under 18" category at pornhub or put it out there on the internet. after the cops kick your door down and arrest you for distribution of child pornography, you will have every opportunity to make your argument in front of the courts. just tell the judge that it aint child pornography because the person having sex with the minor in that video was only 18 years old and not 30 or 40 years old!

the article that @idrankyourbeer posted said that the video was being passed around i.e. was being distributed. Now maybe it was somehow taken without his consent or maybe the 17 year old girl was the one that started sharing it. But knowing teenage boys...I think its HIGHLY likely that he shared that video with others.

I feel like all of that makes sense when it comes to sexual acts and age of consent laws, but when it comes to filming it a hardline should exist. If you want to use this discretion in sentencing for less harsher punishments I think that is fine as well, but I do believe a hard line should always exist for this specific thing: filming a sex act involving a minor.
