The indictment charged Trump with 34 felony counts of falsifying business records in the first degree, in violation of New York Penal Law §175.10. Each count is related to a specific business document, each having a date ranging from February 14 through December 5, 2017:[7]

  • 11 for invoices from Michael Cohen
  • 9 for general ledger entries for Donald J. Trump
  • 3 for general ledger entries for the Donald J. Trump Revocable Trust
  • 8 for checks from Donald J. Trump
  • 2 for checks from the Donald J. Trump Revocable Trust
The allegedly falsified documents are related to Trump's payment to Stormy Daniels as hush money. The payments were listed in the business records as a legal expense payable to Michael Cohen, whereas the indictment alleges that they were actually to reimburse Cohen for the earlier, allegedly illicit, payment to Daniels.[91][92]

Wasn’t he the sitting potus when the feds passed on it? Or am I misremembering that? NY can prosecute under its own laws, so I guess it doesn’t really matter.

ETA: Trump could end up only paying fines even if convicted, I believe.

technically he could be seeing up to 5 years prison time because the misdemeanor charges of falsification of business records got bumped up to felonies because it was done to cover up the violation of statute 17-152, but as a non-violent first time offender, its rather unlikely that he will receive a prison sentence at all.

I don’t think it would matter. Edwards lost his election.
As far as the fraud charge, it doesn’t matter what something is called in an accounting ledger, the real question is how does it effect that years profit and loss statement.
If it makes the P&L statement look more attractive to investors or creditors, then fraud might apply.
