Worst Case Scenario: Firearm Election Fallout

Small 2A victory today as the put the Arm Brace bullshit on the back burner. Not to say they might try again after January, but for now Braces are back to not being targeted for regulation.

Time to finish getting my lower together for the brace then filing the forms to SBR it. I know that means I have to report to the ATF when I take it over state lines but then they won't be coming for me and I'll still have the brace and naturally build ANOTHER pistol to leave as a pistol.

And then you won't leave it as a pistol and have to build yet another pistol.....that you won't leave as a pistol.

I have fallen into that trap many times. I'm currently waiting for my latest sbr stamp.

I sense even though I make decent money that after the one SBR stamp and another for a suppressor I could use on my .308, 6.5, and 5.56 I won't want to deal with the process again.

I say that and watch I'll buy a Barrett and a can for it too to own the longest rifle ever made lol.

Once again, I am surprised more guys aren't building Non NFA "Other" firearms that can be transported legally without ATF notification.
A 12.5 weapon isn't that much longer than a 10.5 SBR for 5.56.

I've never payed attention to them. Is it more of a benefit to certain states? 12.5 is a great barrel length.

Well.....I live in a ban state and the gun manufacturers made these, took it to the state, proved it didn't violate the AW ban by the letter of the law, and won. So we've been buying them ever since, and the state is no doubt gonna visit these and try to ban these as well if Biden doesn't do it first. California just tried it calling it a Title 1 weapon, but their DoJ shut it down immediately, so it's gonna go to court.

My statement is for those free state guys who never have to think outside the box for weapons. You can buy rifles or pistols without issue, but then I hear about all the hoops you gotta jump through to transport NFA items. And I wonder why bother when you can just build a Non NFA Item that is near SBR in length and function without the tax stamp hassle. All you have to do is build to a particular template and your good to go. All you have to do is start with a virgin lower receiver that is transferred to you as an "Other" since it hasn't been built into anything yet. As long as you don't ever configure it as a rifle or pistol it stays a "firearm".

I also have a fear that the ATF might reword their transfer papers to eliminate the word "Other" altogether. And require buyers to state whether the weapon is gonna be a Pistol, Rifle, or AoW upon purchase. In that instance my ban state still has provisions for AOW's unless they kill those too.

Okay, figured it was more of a certain states thing. I've never left my state with an sbr and probably just wouldn't take an sbr across state lines but the paperwork isn't that difficult if you know the dates you will be traveling. So it doesn't really mean anything to me personally.

Can stamps take some time....but e-filing for an sbr (as long as you are making it and not buying it) is rather simple and doesn't take long for the paperwork to come back.

You can do a year in advance for crossing state lines with an sbr....I go to PA to hunt and just do the paperwork from January to December.

There is definitely a wait time discrepancy between Form 1 (Building) vs. Form 4 (Purchasing). I think it's one to 2 months versus 6 months to a year.

That's why there was such an uptick in "Solvent Trap" sales, Only folks weren't filling out Form 1's before buying them thinking the ATF wasn't keeping tabs and got busted violating the NFA for suppressors.

You can do that? I thought it specifically asked for a leave and return date.

Yes. So while a pain it's still once a year and there are boxes for 3 nfa items on each form. It does ask for a leave and return date. Fill out Jan xx 2021-Dec xx 2021. Fill out paperwork, scan, email.

Average time for my stamp for sbr's I built is 30 days....although the prints and cover sheet I mailed a week ago still isn't in WV. Usps has been so slow lately.

And if they can approve building an sbr in 30 days there is no reason they should take 3-5 times longer when someone wants to purchase one.

Well people are lazy or don’t have the knowledge or inclination to build. So I’d surmise double or triple the amount of applications?

I live near the ATF center where everything is processed. Funny enough, when friends have sent things in for approval the forms still go to the Baltimore mail center for processing before being sent back to Martinsburg.

I personally was a bit intimated by the process before I actually decided to do it. Lack of knowledge and finding good resources to help. Finally found a really good ffl with cool employees that walked me through everything with charging me. It's really easy once you know what to do. Mild hassle but imo worth it to have suppressors and whatnot.

Being a government agency.....that doesn't surprise me.
