Law Pelosi desk "invader" asks judge for freedom to sell cars

The dude went out of his way to pose for that famous picture and made himself one of the poster children for this incident. I'm not surprised that an example is being made of him. I also don't feel sorry for him and I don't buy into the idea that this was simple trespassing.

You don’t feel sorry for a guy being put in solitary for three months with no bond? Because you disagree with him politically? You sound like a damned fascist.

and yeah. It’s trespassing, DC and CDTP at most. You don’t realize how low of a standard it is to charge someone with any crime. Hint: it’s the same standard cops use to search your car if they smell weed.

educate yourself.

They have a picture of him sitting at the desk in the capitol with a stun gun in his pants. I would say that meets the standard to charge him with all of the shit he was charged with. He also said he was a nationalist and prepared for a violent death which would have made me question if he should have been released at all.

Is there a specific statute that deals with trespassing on the Speaker of the House’s office? There’s no difference at common law.

So far I see a criminal trespass, criminal damage to property, misdemeanor theft (for her papers, worth less than $500), and disorderly conduct. Most people charged with that are let out on an OR bond. But instead, you have activist prosecutors who overcharge and a fascist judge who didn’t give him a bond until the DC circuit forced him to. It’s a fucking disgrace.
While there isn't specifically to the speaker of the house there are specific laws regarding the capitol building.

Haha so because he had a stun gun in his pants he should be denied bond and detained for three months? People charged with murder are given bonds, so are rapists and child molesters. Had the DC Circuit not forced the judge to give him a bond, he’d still be in jail for a non violent offense. “But he took a picture so he waived his constitutional rights!”

gtfo fascist.

Mitigating vs aggravating factors

But by all means, please enlighten us with where you got your JD from and which states have admitted you to the bar.

Also, feds don't fuck around

haha right! Every single Blood and Crip who gets arrested shouldn’t get bond either, right? Fuck with powerful people, right?

funny how the left will defend this crap and then cry for suspected terrorists at gitmo
Stating something happens isn’t a defense of it, you know that right?
But here’s the reality this person was apart of the insurrection at the capital, that’s a pretty rational thing to deny bail for. I mean if he was serious about overtaking the capitol then for sure he’d be serious about running from the law. And bail is denied all the time for shit like that.

Jan 6th...never forget

The government cares more about their stuff than this guys life. How shameful of them!

I never said it was fair, I said I didn't feel sorry for the guy. There are endless examples of the justice system being unfair. You are minimizing what he did because you agree with him politically. Educate yourself.

University of Missouri.

I’m licensed in Missouri and Kansas. I took the UBE in 2017 and scored a 292.

I was a prosecutor for two years out of law school and saw how people are overcharged.

Tell me what aggravating factors are. Was it s violent crime? No. Was he a flight risk? No. He’s not rich and you can take his passport. Does he have a history of failing to appear? Not that we know of. Does he have a criminal history that shows a pattern of repeat offenses? No. Go ahead and tell me what the aggravating factors are, you stooge.

absolutely disgusting that the judge held him for that long with no bond.

who said I agree with him? I’m saying the judge is a fascist for holding him without bond for political reasons.

lol once people call it an “Insurrection” I realize they aren’t rationale. You honestly think he was planning on taking over the government by sitting in pelosi’s office? What happens the next day? Are they apart of the new government? It looked to me like they were a bunch of idiots fucking things up. Not planning on overthrowing the government, especially since they just left once they were told to leave lol.

the organizers of CHAZ, who actually declared that they were seceding from the US and overtook US land for a period of time and had a quasi government agent treated like that. It’s ridiculous.

And you set a high bond to ensure that they don’t leave or aren’t capable of finding being on the run or give them an incentive to appear for court again so they get the bond back. You take their passports to ensure they do t run. You don’t deny someone their rights.

what has he been found guilty of?

I guess you don’t believe in bail. Get caught with a joint? Guess you’ll have to rot in county until your case is adjudicated. Let’s hope the prosecutor doesn’t ask for any continuances.

he’s a non violent offender and should be afforded bail. The judge is a tyrant and a fascist.

I absolutely believe in bail, but it's contingent on the crime, the threat you present and your flight risk.

I don't know why this man is still being held, maybe there's an article out there that can explain why. I'd prefer not to assume.

Flight risk is mitigated by taking his passport. It was a non violent crime so there’s little risk of harm to the public.

he was eventually given a bond when the DC circuit made the judge give him bond.

He's not being held. He's at home and wants permission to travel to a car show. He was held for a few months after he was arrested. He probably wants to sell more signed photos of himself.

So remember the pelosi desk guy ? well here is an update on him:

"The alleged U.S. Capitol invader photographed on Jan. 6 putting his foot up on a desk inside House Speaker Nancy Pelosi’s office with a stun gun in his pants asked a federal judge to free him up to buy and sell classic cars on Tuesday.
During a less than half-hour hearing on Tuesday, U.S. District Judge Christopher R. Cooper asked whether Richard “Bigo” Barnett’s car trade is a business, or more of a “side hustle.”

Barnett’s lawyer Joseph McBride described his client’s business as a lifelong hobby that became a primary source of income following his ongoing prosecution in connection with the Jan. 6th siege of the U.S. Capitol.

“This is the only way that he has the opportunity to make ends meet, provide for his family and pay for his legal defense,” McBride told the court.

Described by one federal judge as “brazen, entitled and dangerous,” Barnett has been awaiting trial on various charges in connection with the Jan. 6th siege on the Capitol. The chief judge of the District of D.C. previously and emphatically kept Barnett in pre-trial detention, citing the note that he left the California Democrat. Bigo was here, you biatch,” said Barnett’s note to Pelosi."

I’m all for this guy being hit with the maximum sentence for such a big security breach but you all are the biggest hypocrites. He’s innocent until proven guilty so if he makes bail let him enjoy his life with whatever restrictions the court gives him till trial. After that he will get whatever sentence he deserves and quite frankly he’s lucky HRT didn’t put him in a body bag.

It was a non violent crime so there’s little risk of harm to the public.
After he was arrested he called himself a nationalist and said he was ready for a violent death. If I were a judge that might make me think he would be ready to fight to avoid further interaction with the government once he was released on bond.
