My point isn't that it makes the shooting illegal it just shows that Kyle wasn't qualified to be there. As good as his weapon handling was he didn’t appear to have the best situational awareness and looked to me to panic and not know what to do when things turned violent.
Yes, but that has nothing to do with this case. He is being charged with murder.
IMO, anyone arguing that he was totally justified being there is naive. This is a 17 year old kid who took an AK to a violent riot in a city that he doesn't live in. He was asking for trouble, and he found it. However, that information isn't pertinent to the charges.
The prosecution is going to have to prove, beyond a reasonable doubt, that Rittenhouse went there with the intention to kill. They won't be able to do this because you can't prove that with video evidence to the contrary. The most telling part is how he shoots two guys and then stops shooting once the third guy puts his hands up. He only shoots that guy's bicep once he lunges for his gun.
All of that is textbook self defense, and it's all on video. But just because you can't prove murder doesn't mean that he's not an idiot who went looking for trouble.
